1. Agreement to These Terms

These Terms and Conditions (“Terms”) govern your use of zenithhvac.ca (the “Website”) and any services provided by Zenith HVAC (“Zenith HVAC”, “we”, “us”, “our”). By using the Website, requesting a quote, or booking a service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website or our services.

2. Our Services

Zenith HVAC provides residential and commercial air duct cleaning, AC cleaning, furnace cleaning, dryer vent cleaning, sanitization and fogging, commercial duct cleaning, and HVAC maintenance. Descriptions on the Website are for general information. The exact scope of work is confirmed with you before work begins.

3. Quotes and Pricing

• Quotes are free and provided without obligation.
• A quote is based on the information you give us, such as home size, number of vents and system type, and on our inspection. If the actual conditions differ materially, we will explain the difference and obtain your approval before proceeding.
• Prices are in Canadian dollars. Applicable taxes, including HST, are added unless stated otherwise.
• Quotes are valid for the period stated on the quote, or 30 days if none is stated.

4. Booking, Scheduling and Access

• Booking requests submitted through the Website, phone, text or email are not confirmed until we confirm the date and time with you.
• You agree to provide safe, clear access to the areas, vents and equipment to be serviced, and to ensure an adult is present where required.
• Please move fragile or valuable items away from work areas. We will take reasonable care of your property but are not responsible for items left in the work area that we were not asked to move.
• Appointment windows are estimates. Delays can occur due to traffic, weather or earlier jobs, and we will contact you if we expect a significant delay.

5. Cancellations and Rescheduling

Please give us at least 24 hours’ notice to cancel or reschedule. If our technician arrives and cannot perform the service because of no access, no adult present, or unsafe conditions, we may charge a reasonable call-out fee. Same-day and emergency appointments may have different terms, which we will tell you at the time of booking.

6. Payment

Payment is due on completion of the service unless otherwise agreed in writing. We accept the payment methods we tell you about at booking. Overdue amounts may be subject to reasonable collection costs and interest as permitted by law.

7. Satisfaction Guarantee

If you are not satisfied with the cleaning work we performed, contact us within 7 days of the service. We will return and re-clean the affected areas at no additional charge. This guarantee covers the quality of our cleaning work only. It does not cover pre-existing damage, equipment failure, or issues unrelated to the work performed, and it does not apply where access to areas was restricted or where new contamination occurs after the service.

8. Health, Safety and Limitations of Service

• Duct cleaning, sanitization and maintenance can improve cleanliness and indoor air quality, but we do not guarantee specific health outcomes, including relief from allergies, asthma or other conditions.
• We do not provide medical, mould remediation or asbestos abatement services unless agreed in writing. If we find conditions that appear to require specialist attention, such as extensive mould, asbestos-containing materials or damaged ducts, we may stop work and recommend a qualified specialist.
• Older or fragile systems may have pre-existing weaknesses. We use reasonable care but cannot be responsible for failures of components that were already worn, damaged or defective.
• References on the Website to industry standards, certifications and affiliations describe our methods and qualifications at the time of publication and do not create any additional warranty.

9. Limitation of Liability

To the fullest extent permitted by law:

• Our total liability for any claim arising from our services or the Website is limited to the amount you paid for the service giving rise to the claim.
• We are not liable for indirect, incidental, special or consequential losses, including loss of use, loss of income or loss of enjoyment.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer protection laws.

Claims for damage should be reported to us as soon as possible and in any event within 7 days of the service so we can inspect and respond.

10. Use of the Website

You agree not to misuse the Website, including by attempting unauthorized access, interfering with its operation, submitting false or misleading information, or using it for unlawful purposes. We may suspend or restrict access at any time.

11. Intellectual Property

The Website and its content, including text, images, logos and design, are owned by or licensed to Zenith HVAC and are protected by applicable intellectual property laws. You may not copy, reproduce or distribute them without our written permission, except for personal, non-commercial use.

12. Photos and Testimonials

With your permission, we may use before-and-after photos of our work, without identifying your address, and reviews or testimonials you provide, for marketing purposes. You may withdraw permission at any time by contacting us.

13. Third-Party Links

The Website may link to third-party sites. We do not control them and are not responsible for their content or practices.

14. Disclaimer

The Website is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted, error-free or free of harmful components, and information on it may change without notice.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute will be subject to the courts of Ontario, without limiting any rights you have under mandatory consumer protection laws.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Website with a new effective date. Continued use of the Website or our services after changes means you accept the updated Terms.
